Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Truefold application at app.truefold.aiand related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Truefold is a data-management platform that connects to your data warehouse and to marketing and commerce platforms you authorize, and automatically generates a semantic layer (a documented map of your metrics and dimensions) with an administrative interface. We may update, add, or remove features over time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity that occurs under your account. Notify us promptly at privacy@truefold.ai of any unauthorized use.

3. Connected data sources

The Service requires you to connect data sources (such as Google BigQuery, Google Ads, Meta, Shopify, and Klaviyo). You represent that you have the authority and all necessary rights and permissions to connect those sources and to grant Truefold access to the associated data. You authorize Truefold to access, read, and process data from connected sources solely to provide the Service to you, as described in our Privacy Policy.

4. Third-party services

Your use of connected third-party services remains subject to those providers’ own terms and policies (including Google, Meta, Shopify, and Klaviyo). You are responsible for complying with them. Truefold is not responsible for third-party services or for changes to their APIs that affect the Service.

5. Acceptable use

You agree not to:

• use the Service in violation of any applicable law or third-party terms;
• access data you are not authorized to access, or connect sources without permission;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
• use the Service to store or process data for unlawful purposes.

6. Intellectual property

Truefold and its licensors own all rights in the Service, including its software, design, and documentation. You retain all rights in your data. You grant Truefold a limited license to process your data solely to operate and provide the Service.

7. Fees

The Service may be offered free of charge during a beta or evaluation period. If we introduce paid plans, we will provide notice and applicable pricing terms before any charges apply.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Truefold automatically generates descriptions, metrics, and dimensions using automated systems; you are responsible for reviewing them before relying on them for business decisions. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

9. Limitation of liability

To the maximum extent permitted by law, Truefold will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months preceding the claim or USD 100.

10. Indemnification

You agree to indemnify and hold Truefold harmless from claims, damages, and expenses arising from your use of the Service, your data, or your violation of these Terms or any third-party rights.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your data is handled as described in our Data Deletion instructions.

12. Governing law

These Terms are governed by the laws of Mexico, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the competent courts located in Mexico for any dispute arising out of or relating to these Terms or the Service.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance.
